In the event of a dispute regarding an online entry, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry, provided such person meets the eligibility requirements of these rules. 'Authorized account holder' means the natural person who was assigned an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. 2. Eligibility. In order to be eligible to participate, each entrant must be employed as a farmer as a primary occupation, as of July 1, 2010, through the date the prize is awarded. Proof of eligibility will be required. Determination of whether entrant meets the eligibility requirements is at sole discretion of Sponsor. This Sweepstakes is not open to the general public. All entrants must be 18 years of age or older as of the date of entry, and upon request by Sponsor's personnel, must provide valid identification showing proof of age prior to completing. NO EXCEPTIONS. Entrants must be legal resident of one of the 50 United States/D.C. or Canada (excluding Quebec). The following are NOT eligible to enter this Sweepstakes: members of the general public who are not primarily employed as farmers; employees of Sponsor, its subsidiaries, affiliates and authorized Dealers; and any of the aforementioned entities' immediate families (spouse and parents, siblings and children, and each of their spouses, regardless of where they live) and persons living in the households of each of these individuals, whether related or not. This Sweepstakes is subject to all applicable federal, state, provincial and local laws and regulations.
3. Winner Selection and Odds of Winning. The potential Sweepstakes winner will be selected from among all eligible entries by a random drawing on or around November 30, 2010, by the Administrator, an independent judging organization whose decisions are final on all matters relating to this Sweepstakes. Odds of winning the one (1) prize depends upon the total number of eligible entries received. If the potential winner is a resident of Canada, the person will be contacted by telephone and must correctly answer a timed mathematical skill question in order to be declared the winner.
4. Prize and Approximate Retail Value ('ARV'). One (1) prize will be awarded. The winner will receive one (1) ReadyStock(tm) Locker and $4,000 in genuine CNH Original Parts or Case IH Original Parts sold at a Case IH dealership to fill the locker as selected by winner. Non-CNH or non-CaseIH (third-party, competitor, etc.) parts not included. Parts selected subject to availability. ARV: $4,500.00 USD/$4,631.00 CDN. ARV is as of date of printing of these Official Rules. The difference in value of prize as stated herein and value at time of prize notification, if any, will not be awarded. Prize is non-transferable and no cash equivalent or substitution of Prize is offered, except at the sole discretion of the Sponsor. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. All federal, state, provincial or local taxes, and any registration, license, fees and/or costs related to prize acceptance and/or use are the winner's exclusive responsibility. If a U.S. resident, winner may be issued an IRS 1099 form for prizes over $600. WINNER MUST ACCEPT DELIVERY AT A DEALERSHIP DESIGNATED BY SPONSOR WITHIN 30 DAYS OR PRIZE WILL BE FORFEITED. Limit one (1) prize per person/email address/household.
5. Winner Notification. The potential winner will be contacted by telephone, mail and/or e-mail within approximately seven (7) days after the drawing. The winner is subject to verification, including verification of age. If prize notification letter or any prize is returned as undeliverable, the corresponding prize may be forfeited. Sponsor is not responsible for any change of mailing address and/or telephone number of entrants.
The potential winner may be required to sign and return a notarized Affidavit (or Declaration) of Eligibility, Liability Release, and a Publicity Release, within seven (7) days of initial notification. Failure to comply may result in forfeiture of prize. Prize won by an eligible entrant who is a minor in his/her state of residence will be awarded to a minor's parent or legal guardian who must sign and return all documents.
6. General Terms.
By participating, entrants agree to these Official Rules, which are final and binding in all respects and that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, participant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of State of Wisconsin without giving effect to any choice of law or conflict of law rules. As a condition of entering, entrants agree (and agree to confirm in writing): (a) to release Sponsor, its affiliates, subsidiaries, retailers, sales representatives, distributors and Administrator, and each of their officers, directors, employees and agents ('Promotional Parties'), from any and all liability, claim, loss, damages or injuries of any kind arising from or incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, including any traveling related thereto (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys' fees and court costs.
